THE TERMS OF THIS PRIVACY & DATA USE POLICY (“POLICY”) ARE LEGALLY BINDING. IF YOU USE OUR SERVICE (AS DEFINED BELOW), YOU AGREE TO BE BOUND TO ALL OF THE TERMS AND CONDITIONS OF THIS POLICY.
Net Gain Marketing, Inc. ("NGM," “MyGovWatch.com,” "we" or "us") respects the privacy of its users and has developed this Policy to demonstrate its commitment to protecting your privacy. This Policy is intended to disclose to you in a transparent manner how we may collect, use and share your information.
This Policy applies to you, as an individual, when you use any of our services as an individual, and applies to your organization when you are using MyGovWatch.com in the context of any other agreement held by your organization with us, whether using our website (www.mygovwatch.com), any mobile site or application, premium services, or any other web-based or mobile service or any offering through any of our websites (collectively, our "Services").
We encourage you to read this Policy carefully when using our Services or transacting business with us. If you have any questions about our privacy practices, please refer to the end of this Policy for information on how to contact us.
Terms of Use
By providing your email on this website, you are granting permission for NGM to store and retain such email and to use it for purpose of emailing you periodically with leads to government procurements and other content from NGM.
We endeavor to make information available to you on a timely basis; however, given the thousands of government agencies at the Federal, state, and local level, no service can ever have all possible available information or have it and publish it instantaneously.
Not all Leads (as defined below) associated with a particular Buyer (as defined below) will appear, or appear timely, on MyGovWatch.com or in any email transmitted to the email address associated with the User’s account;
MyGovWatch.com bears no responsibility for the manner in which a Buyer creates, refers to, or names RFP Titles (as defined below) for procurements or the manner in which the User completes or modifies the User’s preferences on MyGovWatch.com, which may or may not result in the User learning of any particular procurement, in a timely manner, or at all.
MyGovWatch.com bears no responsibility for the availability or accuracy of any Due Date (as defined below), particularly any Due Date listed on MyGovWatch.com or in any email transmitted to the email address associated with the User’s account.
Please be aware that MyGovWatch.com’s provision of a “Lead” to the User does not include procurement or other documents. For the purposes of defining what constitutes a “Free Lead” as advertised or used by MyGovWatch.com in any of its services, the term “Lead” shall consist of the combination of the name of the “Buyer” (i.e., a government entity that appears on MyGovWatch.com), the “RFP Title” (i.e., the name a Buyer has ascribed to a procurement that appears on MyGovWatch.com), and any corresponding “Due Date” (i.e., the date appearing on MyGovWatch.com by which interested parties must make an offer to a Buyer in order to qualify to be selected for a specific procurement) where available. The User agrees these data points constitute a “Lead” in whatever form the User obtains the information from MyGovWatch.com, whether in an email delivered to the email address associated with the User’s account or through any part of the MyGovWatch.com website, and access to procurement or other documents falls outside of this definition. The User agrees that any “RFP Number” (i.e. any combination of characters ascribed to an RFP Title by the Buyer for tracking purposes) is not part of the definition of a “Lead” as used by MyGovWatch.com or as listed on MyGovWatch.com or in any email transmitted to the email address associated with the User’s account, but may be presented solely for the convenience of the User.
Please note there may be limitations on the availability of documents through MyGovWatch.com due to other legal or practical restrictions. As a result, the User may have limited or no access to certain documents that are beyond our control. Please read the specific terms applicable to each product or service when ordering.

Information Sharing
We share information limited to your identity, interests, role, and preferences, related to government procurements generally or in reference to particular government procurements, with other website users, including information concerning government procurement(s) in which you have expressed any interest. We may also share your information in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us. We may share it when we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our terms and conditions or other agreements or policies. We may share it in connection with a corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
We do not share your personal information with others except as indicated herein or when we inform you and give you an opportunity to opt out of having your personal information shared.
Any third parties to whom we may disclose personal information may have their own privacy policies which describe how they use and disclose personal information. Those policies will govern use, handling and disclosure of your personal information once we have shared it with those third parties as described in this Policy. Please note that these entities or their servers may be located either inside or outside the United States.
Information Protection
We take reasonable security measures (including physical, electronic and procedural measures) intended to help safeguard your personal information from unauthorized access and disclosure. For example, only authorized employees, contractors, and service providers are permitted to access personal information, and they may do so only for permitted business functions. In addition, we use firewalls to help prevent unauthorized persons from gaining access to your personal information.
No system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, or searches, or other information will always remain secure.
No Rights of Third Parties
This Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the Services.
Cancellations / Refunds
You have the right to cancel service at any time, for any reason. Unless your organization is subject to a separate agreement related to premium services, you may cancel your paid National or Regional edition by accessing the tools available to you in the Your Plan & Add Ons area of the site. If you cancel a paid National or Regional edition, you will be downgraded to the free Basic edition thereafter.
Refunds are not granted for payment transactions that have already taken place unless a system error has occurred as identified by NGM upon receiving an inquiry regarding such a transaction. If you cancel service as described above, you will not receive a refund for any prior payment transaction that has already occurred, but you will not be billed again in the future.
Changes to this Policy
NGM reserves the right to amend this Policy at its sole discretion and any modifications shall be effective immediately upon posting. When we revise this Policy, we will notify you by posting the new Policy on the Services with the “Last Updated” legend at the top of this page. By continuing to use the Services following such changes, you will be deemed to have agreed to such changes. If you do not agree with the terms of this Policy or any changes thereto, you may not continue using the Services.
